1. Parties and acceptance
These Terms of Service govern the use of Arkantara, a school management platform operated by CV Bulung Gadung (“we”). “School” means an educational institution that subscribes to Arkantara. “User” means anyone who uses an account in Arkantara, such as administrators, teachers, employees, students, and guardians.
By using Arkantara, the School and Users agree to these Terms of Service and the Privacy Policy. If the School has a separate written agreement with us, that agreement applies together with these terms and prevails where they differ.
2. Service
Arkantara provides school management modules, including master data, academics, attendance, learning and exams, PPDB admissions, finance, communication, and administration. The modules available to the School follow its subscription package.
We continually develop the service and may add, change, or discontinue features. We notify the School before discontinuing a feature in active use, and feature changes do not remove the School's access to its data.
3. Accounts and security
- Accounts are created through an invitation from a School administrator, or through self-registration if the School allows it. One account per person.
- Users must keep their password and verification devices confidential, and notify the School promptly if they suspect someone else is using their account.
- Users are responsible for activity carried out with their account.
- Students who are children use accounts provided by the School with the knowledge of their parents or guardians.
4. School responsibilities
As the personal data controller, the School is responsible for:
- having a lawful basis to process the data it records, including parent or guardian consent for children's data where required;
- ensuring that recorded data is accurate and up to date;
- assigning roles and permissions to Users according to their duties, and deactivating accounts that are no longer needed;
- setting internal policies on the retention and deletion of its operational data;
- handling payment transactions between the School and guardians that use the School's own payment account, including refunds.
5. Prohibited use
The School and Users must not:
- access other people's data, accounts, or schools without authorization;
- attempt to breach, test, or bypass the service's security and limits without our written permission;
- extract data automatically in bulk or place an unreasonable load on the service;
- upload content that is unlawful, contains malicious code, or infringes the rights of others;
- use communication features to bully, harass, or send unsolicited bulk messages;
- copy, resell, or reverse engineer the Arkantara software.
6. Trial, subscription, and payment
- New schools receive a 14-day trial with all modules. If the trial ends without a paid package, access is limited to core features and the School's data is not deleted.
- Package prices are stated in rupiah for monthly or yearly periods, according to the current price list or a written agreement.
- The first period's invoice is due 7 days after issue. Renewal invoices are issued 7 days before the current period ends.
- Payment is made through DOKU or another method agreed between us and the School.
- If a period ends before its invoice is paid, the School receives a 7-day grace period. After that the subscription ends and access is limited to core features; the School's data is not deleted.
- Fees already paid are non-refundable, unless required by law or agreed in writing.
- Taxes, where applicable, follow the prevailing laws and regulations.
7. Suspension and termination
- The School may stop subscribing by not renewing its subscription or by notifying us.
- We may suspend access for a School or User that violates these Terms of Service or endangers the security of the service. Where possible, we give prior notice with the reason. During suspension, data is not deleted.
- As long as the School has not been archived or suspended, an administrator with export permission can download all School data, including after the subscription ends.
- After the School is archived, its data remains stored and can be restored. At the School's request, data can be permanently purged no earlier than 30 days after archiving. Purging cannot be undone.
8. School data and intellectual property
- Data recorded by the School and Users remains the School's property. The School grants us a limited permission to process that data solely to provide the service, in accordance with the Privacy Policy.
- The Arkantara software, design, and brand belong to us. These terms do not transfer those intellectual property rights to the School or Users.
- We may use feedback you provide to improve the service without any obligation to you.
9. Availability and support
- We strive to keep the service available and back up the database daily, but we do not guarantee uninterrupted service unless agreed in writing in a service level agreement.
- We announce scheduled maintenance that may disrupt the service in advance where possible.
- The School can request support through the support menu in the app.
10. Limitation of liability
- To the extent permitted by law, the service is provided as is. We are not liable for indirect losses, lost profits, or losses resulting from input errors, Users' failure to secure their accounts, or third-party disruptions beyond our control.
- Our total liability to the School for any claim is limited to the subscription fees paid by the School in the twelve months before the event giving rise to the claim.
- This limitation does not apply to losses caused by our intentional misconduct or gross negligence, or that cannot be limited by law.
11. Changes to these terms
We may change these Terms of Service. We notify the School of significant changes at least 14 days before they take effect. By continuing to use the service after the changes take effect, the School and Users are deemed to accept them.
12. Governing law and disputes
- These Terms of Service are governed by the laws of the Republic of Indonesia.
- Disputes are first resolved by deliberation within 30 days after one party notifies the other in writing. If no agreement is reached, disputes are resolved through the district court in the jurisdiction where CV Bulung Gadung is domiciled.
- These terms are available in Indonesian and English. In case of any difference in interpretation, the Indonesian version prevails.
